Consent and Disclosure for Electronic Records

Account agreements and other communications by us, including without limitation, account opening documents, authorizations for electronic funds transfers, regulatory disclosures, tax information, account and service notices, changes in applicable terms, account maturity and default notices, account errors or dispute investigation notices and account applications and certifications (collectively, "Communications") can be provided in electronic form for the deposit account(s) and/or loan account(s) designated by you during your account application online at Key.com. Clicking the "Accept" button below means you are agreeing to accept all electronic Communications when presented online, and that all such Communications will apply to you and your account(s).

Before opening an account or obtaining products and services electronically from us, you must read and accept the applicable online terms and conditions. In this Electronic Records Disclosure, "we", "us", and "our" refer to KeyBank National Association, Key Investment Services LLC, and their current and future affiliates, whose account(s) and/or services are obtained through Key.com (the "Website") or any other application method approved by us. Please read this entire document and save or print a copy of this Agreement and all electronic Communications for your records.

Notice and Consent:

To open your account(s) and receive Communications online, you must have the following minimum computer hardware or software:
  1. an Internet browser (Microsoft® Windows 95 or higher, Windows NT 4.0 or higher with Microsoft Internet Explorer 5+, Netscape 4.6+ or AOL 4+) that supports 128 bit encryption;
  2. an email account with an Internet Service Provider and email software in order to participate in our electronic Communications program; and
  3. a personal computer (for PCs: Pentium 120 MHz or higher; for Macintosh, Power Mac 9500, Power PC 604 processor 120-MHz Base or higher), operating system and telecommunications connections to the Internet.

Account Express Plan for Deposit Accounts

Clicking the accept button below means you are agreeing to the terms and conditions of the Plan for deposit accounts opened under the Plan through any channel at KeyBank National Association (the "Bank").

The Account Express Plan ("Plan") authorizes the Bank, at its discretion, to open one or more personal deposit accounts (including checking accounts, savings accounts, certificates of deposit but excluding passbook savings accounts) upon the receipt of electronic, written or oral instructions from you without obtaining a signature on any additional Plan or signature card for your deposit account. You understand that all deposit accounts opened by you under the Plan will be owned by you in the same capacity, and any other account ownership will require a separate Plan. You understand that the accounts will be opened when the funds are received at the Bank. This Plan and related electronic record is the electronic signature card for all accounts opened under this Plan.

You hereby authorize the Bank, at its discretion: (i) to act upon your instructions to deposit, withdraw or transfer funds to or from any other accounts (except passbook savings) at the Bank when opening new accounts; (ii) to recognize and honor your manual signature on checks (if withdrawal by check is permitted) and withdrawal slips and honor any other electronic, written or oral requests for withdrawals or transfers of funds, including transfers to the Bank or to third parties and (iii) to act upon your instructions for the transaction of any business on any accounts covered by this Plan. You hereby agree the Bank may receive your instructions from any source including: electronic communications, computer, telephone, US mail or in person at the Bank. You understand and hereby agree the Bank may obtain your credit history (credit or consumer report) and employment history from third parties for purposes of opening and maintaining a deposit account with the Bank. You have the right to ask the Bank whether it requested a consumer or credit report. If the Bank obtains a consumer or credit report, the Bank will supply the name and address of the consumer reporting agency upon your written or electronic request.

All accounts opened under the Plan are subject to the Deposit Account Agreement and Funds Availability Policy ("Deposit Account Agreement"). The Deposit Account Agreement and a written disclosure are posted online at the Bank's Website for 90 days after the account is opened. You may view online and print or save a copy of the Deposit Account Agreement and disclosure of the interest rate, annual percentage yield, fees and other terms and disclosures relating to the account at the time of applying online for such deposit account, or you will receive a printed copy of the Deposit Account Agreement and such disclosures if the deposit account is opened at a Bank branch or via telephone. You hereby agree to be bound by the terms and conditions of the Deposit Account Agreement and the written or online electronic Communications, as both are amended from time to time.

You understand that the Taxpayer Identification Number/SSN Certification set forth in your account application applies to all accounts opened under the Plan.

The Plan is governed by the laws of the State of Ohio without regard to conflict of law principles, and you and the Bank expressly exclude NCCUSL’s model Uniform Computer Information Transaction Act as adopted and/or modified into state law in each jurisdiction.

Attention New Customer. The information you are providing to open your new Bank account is subject to review and verification. The Bank reserves the right to close your account in the event we are unable to verify, to our satisfaction, the information you provided.
